No, you may not pay your deductible If other driver was at fault because in that case you may file your claim with the at-fault party’s insurance company, because if you file the claim with your insurance company ,then you may pay the deductible and your insurance company may recover the damages from the at-fault party’s insurance company. This is called subrogation.
